1. Agreement to Terms

By accessing or using Recall Radar ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

Recall Radar provides automated product recall monitoring services for e-commerce sellers. The Service monitors regulatory databases and marketplaces to identify product recalls that may affect your products and sends alerts to subscribers.

3. Account Registration

To use the Service, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Subscription and Payment

The Service is offered on a subscription basis with the following terms:

• Subscription fees are billed in advance on a monthly or annual basis
• Fees are non-refundable except as required by law
• We may change subscription fees with 30 days notice
• You may cancel your subscription at any time from your dashboard
• Cancellations take effect at the end of the current billing period

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Resell or redistribute the Service without authorization
• Use the Service to monitor products you do not own or have rights to
• Circumvent any usage limits or restrictions

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RECALL RADAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Recall Alert Disclaimer

While we strive to provide timely and accurate recall alerts, Recall Radar does not guarantee that all recalls affecting your products will be detected or that alerts will be delivered without delay. You remain solely responsible for compliance with all applicable product safety regulations and should not rely exclusively on our Service for recall monitoring.

9. Indemnification

You agree to indemnify, defend, and hold harmless Recall Radar and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service, your violation of these terms, or your violation of any rights of another.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.
